1. General Provisions

PLEASE READ THOROUGHLY THE ENTIRE TERMS OF USE BEFORE USING AND ACCESSING LOOKIN APPLICATION.

This Terms of Use is used as an agreement between Lookin User (“Anda” or “User”) and PT Lokal Orang Indonesia (“Lookin”, “We”, “Us”, or “Our”), a limited liability company established and existing under the law of the Republic of Indonesia and domiciled at DKI Jakarta, Indonesia. This terms of use regulate the use of User in Lookin App, websites (www.lookinid.com and other websites we manage), and content that Lookin and/or Lookin’s affiliates provide (hereinafter, collectively referred to as “Application”), as well as other services available on our Application provided by us and/or our affiliates (“Service or Services”).

By agreeing to this Terms of Use, You also agree to additional Terms of Use and changes that are integral part of this Terms of Use (hereinafter, the Terms of Use, the Additional Terms of Use, and its changes are collectively referred to as “Terms of Use”).

2. User Registration

To use the Application safely, You must download the official version of our Application that is available in Appstore (for IOS User) or Playstore (for Android User).

To access the Services, You must agree to this Terms of Use and Privacy Policy, and register Yourself by providing information We need. We will ask You to provide several information including your complete name, username, email address, and password required anytime before accessing the Application.

After completing the registration process, our system will automatically generate a One Time Password code (“OTP”) and which then automatically sent by our system to your registered email. You need to activate your account by entering such OTP to verification page within the Application.

If you log out of your account, you will need to enter your email address and password again to log back in. In case you forget the password, you created during registration, you can access the "Forgot Password" feature. You will need to verify your account again by entering the new OTP (One-Time Password) code that we send to your email address on the OTP verification page within the Application.

THE OTP IS PRODUCED AUTOMATICALLY BY OUR SYSTEM. WE DO NOT KNOW AND NEVER ASK FOR YOUR OTP. NEVER PROVIDE THE OTP TO ANYONE EVEN TO US OR ANY OTHER PARTIES WHO ACKNOWLEDGE THEMSELVES AS OUR REPRESENTATIVES.

2.2.1.</strong >Electronic Know Your Customer (E-KYC) Verification

Before accessing and/or using the entire Services, You need to verify your identity (“E-KYC Verification”) by following these steps in our Application:

  • Take and submit your selfie photo to us;

  • Take and submit a photo of your ID; and

  • Verify the acuracy of your Personal Information that is automatically generated by our system through the use of our Optical Character Recognition (“OCR”).

Those Users who have successfully completed the E-KYC Verification process will receive a checkmark indicating that their identity is valid, and they are a verified individual.

THE E-KYC VERIFICATION PROCESS IS CONDUCTED THROUGH A SERIES OF ANALYSIS STEPS USING DATA FROM LEGITIMATE AND TRUSTED SOURCES FROM GOVERNMENT PARTNERS THAT ARE COLLABORATING WITH US. YOU EXPRESSLY AGREE TO ACCEPT ANY OUTCOME OF OUR E-KYC VERIFICATION. YOU EXPRESSLY DECLARE TO ENSURE AND WAIVE RIGHTS, BASED ON APPLICABLE REGULATIONS, TO MAKE ANY CLAIMS OR LAWSUITS REGARDING THE OUTCOME OF OUR E-KYC VERIFICATION.

3. User Statement and Commitment

In order to provide secure, reliable, and compliant services, you are required to give your consent to the following statements and guarantees:

  • You declare and guarantee that you are at least 18 (eighteen) years old, or you are married and not under the guardianship or custody of parents or legal guardians. If you do not meet these criteria but still use and access the content, application, and services, you declare and guarantee that all of your actions have been approved by your parents or legal guardians. You declare and guarantee that you will not use the rights provided by the applicable regulations to cancel and revoke any requests and approvals you have given us through the application.

  • You declare and guarantee that you have read, understood, and voluntarily agreed to comply with all the terms and conditions of the Terms of Use.

  • You declare and guarantee that you will only use the content and services on the application for lawful purposes and will not engage in any illegal activities, acting in good faith and with due diligence.

3.1 Permissions Granted to Us

  • You grant us a non-exclusive, royalty-free, transferable, and worldwide permission to use, distribute, modify, duplicate, translate, and create derivative works from the content you create, upload, and share within the Application.

  • You grant us permission to use your name, profile picture, and account activity without any compensation to you.

  • You grant us permission to install updates to the Application on the device you use.

4. Privacy Policy

You agree that you grant us the authority and rights to collect, store, process, and utilize your personal information, such as identity data, contact data, and location data, which you provide including but not limited during registration. Furthermore, you will adhere to the Privacy Policy, which is an integral part of the Terms of Use.

5. Prohibited Activities

  • You are prohibited from using the Application for purposes, transactions, and activities that violate the law or any applicable regulations.

  • You are prohibited from using the Application to distribute and/or make accessible electronic information that contains

    1. Abusive content;

    2. Obscene or indecent material;

    3. Gambling-related content;

    4. Defamation, slander, extortion, and/or threats;

    5. Illegal drugs and prohibited substances;

    6. Weapons, ammunition, or explosives;

    7. Animal trading;

    8. Alcohol;

    9. Goods or services involving criminal elements such as fraud, deception, violence, coercion, cheating, or disruption;

    10. Goods or products containing sexual content and obscene acts;

    11. Sales of devices that facilitate or encourage the illegal streaming of digital content or disrupt electronic functions; and

    12. Other matters as determined by Lookin in the future.

  • You are prohibited from using the Application for provocative purposes and/or spreading false and misleading news.

  • You are prohibited from attempting to create accounts, access, or gather information in unauthorized ways, including automated means without written permission from us.

  • You are prohibited from posting other people's personal or confidential information without permission, or engaging in any activities that infringe upon the rights of others, including intellectual property rights such as copyright and trademarks.

  • You are prohibited from modifying, translating, creating derivative works, or reverse engineering our services without our written consent.

6. Intellectual Property

All information in the Application, including but not limited to names, logos, designs, data, processes, business models, know-how, and all other information available within the Application or on our managed website, are the property or intellectual property rights owned by us. You agree that you cannot use our intellectual property rights without our consent.

We grant you a limited, non-transferable, and non-exclusive license to download, install, use, and access our services and Application as they are, solely for your personal use and subject to the terms and conditions of the Terms of Use.

7. Limitation of Liability

  • We provide the content, services, and Application "as is," and we do not guarantee that the content, services, and Application will be secure, reliable, or functioning properly at all times. The Application may experience limitations, delays, and other issues that can occur in internet usage and internet communication.

  • We do not control what people do or their actions, and we are not responsible for the actions or conduct (both within and outside the network) or content (including unauthorized content) of users (including yourself). We are also not responsible for services or features offered by other individuals or parties, even if accessed through the Application.

  • In the event of any issues with the Application, we may not be aware of all the consequences. You agree that we are not liable for any loss of profits, revenue, information, or data, or any other losses arising from or related to theTerms of Use, even if we were aware that such issues could occur. The same applies when we delete your content, information, or account.

7.1 Your responsibility as user of Application

  • Any content or material that you obtain through the use of the services and Application is your responsibility, and you voluntarily assume all risks arising from the use of the services and Application, including the risk of data loss on the device you use or own in connection with the use of the services and Application.

  • You are responsible for the use of the services and Application, including refraining from using any equipment, software, or other technologies that may hinder the operation of the services on the Application.

  • You are fully responsible for any reviews and comments on the services and Application from time to time.

  • Your account can only be used by you, and you cannot transfer it to anyone else for any reason.

  • You hereby agree and undertake not to:

  • Take any actions that burden or may burden the Application along with its infrastructure for service provision.

  • Create links to the Application and use the Application for commercial or other purposes without our consent.

  • Use the Application for purposes that are contrary to the applicable laws and regulations.

  • Engage in any other actions that contradict the Terms of Use and the applicable laws and regulations.

8. Deletion of Content and Termination of Application Use

We may remove any content or information that you share through the Application if we believe it may violate the Terms of Use. We reserve the right to refuse to provide or discontinue providing part or all of the services to you (including terminating your access to the Application) immediately in order to maintain the integrity of our services and/or Application.

To the extent permitted by applicable law, we may retain your data and information even if you have closed your account. You may also request the deletion of your data or personal information by submitting your request directly to [email protected].

8.1. Account Deactivation

Your account will remain active indefinitely unless you decide to close your account by accessing the available feature within the Application or by submitting your request directly to [email protected].

9. LINKS TO OTHER WEBSITES OR APPLICATIONS

In the Lookin application and website, there may be links to other websites or applications. You hereby understand and acknowledge that we do not have control over these other applications or websites. We are not responsible for any events or consequences that may occur when you access other applications or websites through the links on the Lookin application and website. It is entirely your responsibility.

10. Applicable Law, Troubleshoot, dan Dispute Resolution

The Terms of Use is governed and interpreted according to the laws and regulations of the Republic of Indonesia.

If you encounter any issues or problems related to the Application, suspect or become aware of unauthorized access or misuse of your account by unknown parties without your consent, you can promptly report your complaints and concerns through the feature provided in the Application or by contacting us through the contact information available in the Terms of Use.

To report complaints, questions, or other matters related to the use of the Application ("Reports"), you need to provide accurate, complete, and true information, along with supporting evidence. We will verify and follow up on the Reports you have submitted. However, we may refuse to act upon your Report if the information provided is incorrect, incomplete, inaccurate, or lacking the necessary supporting evidence.

You and we agree that any and all disputes arising from the use of the Application are subject to the dispute resolution mechanism through the jurisdiction of the South Jakarta District Court.

11. Release and Indemnification

You agree to release us from any claims and hold us harmless (including our shareholders, affiliates, directors, commissioners, and employees) from any claims and demands made by third parties arising from any violations you commit in connection with the use of the services and Application.

In such cases, if there are any losses incurred and experienced by us, we have the right to seek indemnification from you due to your actions.

12. Force Majeure

You acknowledge that the Application may be interrupted by events beyond our authority, capability, or control ("Force Majeure Events"), including but not limited to natural disasters, power outages, telecommunication disruptions, government policies, and other events of a similar nature. You agree that no party shall be held responsible for our failure to provide all or part of the services within the Application due to such events.

14. Changes to the Terms of Use

We may modify some or all of the terms and policies in the Terms of Use and its derivatives, including the Privacy Policy, without requiring your consent. Unless otherwise required by applicable law, we will notify you before making changes to the Terms of Use and its derivatives, including the Privacy Policy. If you continue to use our services and Application, you will be bound by the latest Terms of Use and Privacy Policy. However, if you do not agree, you can promptly close your account in accordance with the Terms of Use.

This Terms of Use is an integral and inseparable part of Lookin's Privacy Policy. By accepting Terms of Use, you acknowledge that you have read and understood the content of the Terms of Use and agree to be bound by it.
